This is technically true and true for the RNC as well because they are not government organizations. But if they altered the charter we would see that it is altered.

participate in the Presidential nominating process
The charter says any proposed changes would have to be released to the national news media 30 days before voting.

subsequently ratified by a vote of the majority of the entire membership of the Democratic National
